The term "Hongkong Company" seems to have been

chosen a little unhappily. There is no objection to

it from the point of view of the Supreme Court for

China, but there is from the point of view of

Hongkong. The natural meaning of "Hongkong Company"

so far as Hongkong is concerned would be either

(a) all companies incorporated in Hongkong; or (b) all companies incorporated in Hongkong other

than China Companies.

The Order-in-Council however applies the term to only

a portion of the second class, 1.8. to Companies

incorporated in Hongkong, which carry on part of their

business in China but are controlled from Hongkong.

It thus leaves us without a name for companies in-

corporated in Hongkong, which carry on part of their

business in some place other than Hongkong and China.

On the other hand it includes in the term "Hongkong

Company Companies which are not incorporated in

Hongkong at all, i.8. Companies incorporated in

China and registered from the outset at Shanghai,
